Introduction

Punchline Poster ("we," "our," or the "Service") is a global web application for comedians to upload short comedy videos, apply creative enhancements, and schedule them for posting across multiple social platforms (e.g., Instagram Reels, TikTok, YouTube Shorts, Facebook Stories). By using the Service, you agree to comply with these Terms and all applicable laws. The Service is available worldwide (with a primary user base in the U.S. and Canada), but all legal matters will be governed by South African law (as set forth below). Punchline Poster reserves the right to modify or suspend the Service at any time. Continued use of the Service after changes means you agree to the updated Terms.

Eligibility

You must be at least eighteen (18) years old to use Punchline Poster. By registering, you represent that you have full legal capacity and authority to form a binding contract under South African law. If registering on behalf of a company or organization, you confirm you have the authority to bind that entity to these Terms. You also represent that you have not been previously suspended or removed from this Service for any violation of law or policy. Anyone providing information to create an account warrants that all details are truthful and complete.

Account Registration

To use most features of Punchline Poster, you must register for an account. You agree to provide accurate and complete information (such as name, email, and any required billing details) and to keep it up to date. You will create a password and are solely responsible for maintaining its confidentiality; all activity that occurs under your account is your responsibility. If you suspect any unauthorized use of your account, you must notify us immediately. You agree not to share or transfer your account to others and to notify us if your contact or payment information changes.

Subscription and Billing

Punchline Poster is a subscription-based service with multiple plans, currently including Tester, Poster, Editor, Open Mic-er, Professional, Headliner, Famous, and Comedy Club. Pricing starts with the Tester plan (free for 7 days) and paid plans start at US$13 per month. We also offer annual billing for paid plans at approximately a 30% discount versus monthly billing. Annual totals are calculated as monthly price x 12 x 0.70 and rounded to the nearest displayed amount. Current plans and pricing are published on our website. By subscribing, you authorize us to charge your chosen payment method for the fees due on your billing date. All fees are quoted in U.S. dollars and are non-refundable except as required by law. You will have the opportunity to review and accept all fees before you are charged. Subscription fees recur automatically each billing period until you cancel. You may cancel or downgrade your subscription at any time; however, already-paid fees will not be prorated or refunded (unless South African law requires otherwise). We reserve the right to change prices or introduce new plans, with notice, but will not affect any paid period you have already purchased.

  • Editor - Studio plan. US$18/month or US$151/year (approximately 30% discount).
  • Open Mic-er - Basic plan. US$13/month or US$109/year (approximately 30% discount).
  • Professional - Advanced plan. US$20/month or US$168/year (approximately 30% discount).
  • Headliner - Growth plan. US$27/month or US$227/year (approximately 30% discount).
  • Famous - Premium plan. US$39/month or US$328/year (approximately 30% discount).
  • Comedy Club - Enterprise-plus plan. US$64/month or US$538/year (approximately 30% discount).

Video Upload and Usage Rights

Users may upload videos and other creative works ("User Content") to the Service. You retain copyright and all proprietary rights in your User Content. You represent and warrant that you have all necessary rights (including copyrights, rights of privacy/publicity, and any consents) to upload and use each video you post. You are solely responsible for the content you upload. By posting content, you grant Punchline Poster and our service providers a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for formatting or enhancement), and distribute that content to provide the Service and post it on your behalf to linked social platforms. You may upload copyrighted material only if you have permission. Punchline Poster does not check whether you have rights to the content you upload, and we will not be held responsible for copyright infringement by users. If we receive a valid takedown request from a copyright holder or law enforcement, we may remove or disable access to allegedly infringing User Content. We will comply with takedown requests as required by law (e.g., under South Africa's Electronic Communications and Transactions Act). Note that Punchline Poster is not responsible for replacing or refunding such content. You agree to indemnify and hold harmless Punchline Poster for any claims arising from your use or uploaded content, including any third-party intellectual property claims.

Third-Party Integrations

Punchline Poster can connect to external social media platforms to post your videos at scheduled times. The Service currently integrates (via APIs) with platforms such as Instagram Reels, TikTok, YouTube Shorts, Facebook Stories, and others you authorize. To use these features, you must have valid accounts on those platforms and grant Punchline Poster permission to post content on your behalf. By linking a third-party account, you authorize Punchline Poster to transfer your videos and related information to that platform. Each third-party service has its own terms and policies that apply to your content; you agree to comply with them. We are not liable for the practices or performance of any third-party network. If a platform changes its API or limits posting, we cannot guarantee continued functionality. We recommend reviewing each platform's terms and privacy policy before using these integrations. Supported Platforms (examples): Instagram (Reels/Stories), TikTok, YouTube (Shorts), Facebook (Stories), and others as added.

Scheduling and Automation

Punchline Poster provides scheduling tools to publish your videos at optimal times. You may select posting times manually or use our analytics-driven "smart" scheduling, which leverages historical comedy viewership trends to suggest when your audience is most active. While we aim to suggest effective posting times, we do not guarantee any particular viewership or engagement outcome. The scheduling system automatically publishes your approved content at the scheduled time across the selected platforms (subject to each platform's capabilities). However, we make no warranties about the Service's uninterrupted operation, timeliness, or ability to post at the exact requested moment. Use of the Service is at your own risk. You remain responsible for checking that your videos are posted correctly.

Intellectual Property

Punchline Poster retains all rights, title, and interest in the Service itself, including all software, code, content (other than your User Content), trademarks, logos, and documentation. We grant you a limited, non-exclusive, non-transferable license to use the Service solely for your personal or business use as permitted by these Terms. You may not copy, modify, distribute, or create derivative works of the Service or its contents, except as expressly authorized herein. The names "Punchline Poster" and associated logos are our registered trademarks. You may not use our trademarks or branding without our prior written permission. Any feedback or suggestions you provide may be used by us without obligation.

Disclaimers and Limitations

No Warranty. The Service (and all content provided through it) is offered "as is" and "as available," without any warranty of any kind. Punchline Poster expressly disclaims all warranties, whether express or implied. We do not guarantee the Service will meet your needs or expectations, nor that it will be error-free, uninterrupted, secure, or free of harmful components. You use the Service at your own risk, and we are not liable for any damage to your device or loss of data from use of the Service.

Content Responsibility. You understand that Punchline Poster does not pre-screen or endorse the User Content uploaded by users. We are under no obligation to monitor or control User Content. We will not be liable for any User Content (including offensive, obscene, or objectionable material). We may, however, remove or restrict access to User Content at our discretion if we believe it violates applicable laws, infringes rights, or severely breaches these Terms. Any legal disputes arising from User Content are solely between the content poster and any complainant.

Limitation of Liability. To the maximum extent permitted by law, Punchline Poster (and its officers, directors, employees, affiliates, and licensors) shall not be liable for indirect, incidental, special, consequential, or punitive damages of any kind. Our total liability for any claim related to these Terms or the Service shall not exceed the amounts you paid for the Service in the six months preceding the claim.

Indemnification. You agree to indemnify and hold harmless Punchline Poster and its affiliates from any claims, losses, or damages (including legal fees) arising out of your use of the Service, violation of these Terms, or infringement of any third-party rights.

Governing Law and Jurisdiction

These Terms and your use of Punchline Poster are governed by the laws of the Republic of South Africa. Any dispute or claim arising under these Terms shall be resolved exclusively in the courts located in South Africa, and you consent to personal jurisdiction there. If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force.
